Tonalgram
Terms of Use
Last updated: October 23, 2026
These Terms govern your use of Tonalgram (the "App"), provided by Octet Software ("we", "us", or "our"). By downloading or using Tonalgram, you agree to these Terms and the applicable Apple Media Services Terms.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Tonalgram on Apple devices you own or control, subject to these Terms and Apple's rules.
2. Purchase
Tonalgram is sold through the Apple App Store as an upfront purchase. The App may also offer optional, non-consumable expansion packs as separate one-time in-app purchases. Pricing may vary by country and may change over time. Apple processes payments, purchase restoration, family sharing where available, refunds, and download history under Apple's policies.
3. Your creations
We do not claim ownership of the original performances, arrangements, text, images, custom patches, MIDI files, or videos you create with Tonalgram. Subject to these Terms and applicable law, you may save and share your Tonalgram exports for personal or commercial purposes.
You are responsible for having the rights to any photograph, text, music, trademark, or other third-party material you add to a project or include in an export.
4. Saved projects and exports
Tonalgram stores projects locally and provides tools for exporting or sharing content. You are responsible for maintaining copies of work that is important to you. Device loss, app deletion, operating-system behavior, or storage failure may remove locally stored content.
5. Acceptable use
You agree not to misuse the App, interfere with its operation, attempt to bypass platform security, reverse engineer it except where permitted by law, or use it to infringe another person's rights.
6. Availability and updates
We may improve, modify, replace, or discontinue features. We do not guarantee that every project, third-party file, device, operating-system version, external app, or sharing destination will remain compatible forever.
7. Disclaimer
Tonalgram is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We do not guarantee uninterrupted operation or that the App will meet every creative or professional requirement.
8. Limitation of liability
To the maximum extent permitted by law, Octet Software will not be liable for indirect, incidental, special, or consequential damages, loss of data, loss of profits, or loss of opportunity arising from use of the App. Our total liability will not exceed the amount you paid for Tonalgram.
9. Apple as third-party beneficiary
These Terms are between you and Octet Software, not Apple. Apple is not responsible for Tonalgram or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Maintenance, support, and warranty claims are our responsibility to the extent required by law.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where the laws of your jurisdiction require otherwise.
11. Changes
We may update these Terms. The date above identifies the current version. Continued use of Tonalgram after an update constitutes acceptance where permitted by law.
